Modular Homes Australia

Expandify terminated Mum's contract today due to "breach of payment".

They now say they'll sell the home she paid $142,433 toward, deduct their own claimed costs and

losses, and give her "whatever is left".

So let me get this straight.

Expandify failed to deliver the home. They failed to complete the work. They still don't have the

nominee required to lawfully finish the job.

But somehow Mum is the one in breach, and they get to recover THEIR costs first?

How the fuck is this remotely okay?

And before anyone asks why we didn't just hand over another almost $70,000:

Mum already had $142,433 at risk. We were not going to push that to more than $209,000 after

months of delays, contradictions, warning signs and unanswered concerns without some

meaningful protection.

Particulary after Tim Austin of © Affordable Modular Buildings had already used the threat of the

company going under, Mum losing her home and losing everything she'd already paid as coercive

pressure to get us to pay early.

So we proposed two pretty basic safeguards:

- Put the payment into Expandify's solicitor's trust account.

- Or at least give us a statutory declaration standing behind their financial position.

They refused both.

And for context, knowingly making a false statutory declaration is a criminal offence in

Queensland.

Interesting that they didn't want to do that. I'll leave it there.

They refused the trust account. They refused the statutory declaration. They still wanted another

almost $70,000 immediately, with no clear pathway to installation or handover.

Not one of those risks was created by us. So why were we the ones expected to carry all of them?

Now Mum is left with no home, no money in hand, a legal fight if she wants to challenge the

termination, and foundations on her property that she can't use and may have to pay to remove.

company to deliver what they sold her. She shouldn't be the one carrying the

Alex you're an absolute legend sticking up for your mum. I really hope this works out

for you, it sucks that you're going to be drawn into a legal battle over this.

Best of luck to you and your mum.

brought Affordable Modular Buildings in to manage the installation side. Whole

thing is a mess.

TinyDown Under To be fair, it's a very large custom build, so the price itself

wasn't really the issue. If they'd actually delivered what Mum paid for, we

wouldn't be mad about the cost at all.

That is bloody disgusting - and protections for buyers of modular homes aren't

sufficient either.

It's terrible you're going through this type of situation.

• ABC News • Channel 7 • A Current Affair: you guys should pick up a story on

this - the bad side of modular home building.

Terrible situation to be in....that's an awesome website you've got there.

You could sell them as packages for other people going through small claims or

disputes with builders to document everything. Brilliant idea to have everything in

one place and laid out. Saves digging through possibly hundreds of emails to get key

dates
