No apology. No accountability. No resolution.
Just a cease and desist letter and another threat to terminate Mum's contract.
The full update, with all the receipts, is here: https://thegrannyflatfiles.com.au/
Affordable Modular Buildings solicitor sent me a cease and desist accusing me of publishing false
and defamatory material, demanding i take it down and publicly apologise. Our solicitor has now
responded. We completely reject the allegations.
Since then, Tim has publicly said AMB withdrew because we didn't make the next payment and
Expandify therefore couldn't pay them.
Except our email to him at the time expressly said Mum was not refusing to pay. We were refusing
to pay almost $70,000 before the contract said it was due.
So l asked him a pretty simple question:
"If we had paid early, would AMB have stayed on the project and installed Mum's house?"
He's had plenty of time to publicly defend the business and make claims the receipts don't
support. He still hasn't answered that question.
Because if the answer is yes, I think most people would agree that is pretty egregious.
That would mean Mum lost her installation pathway because we wouldn't give in to what I consider
unethical pressure to pay almost $70,000 before the contract said it was due.
Expandify's solicitor has also suggested I take the website down because my public posts are "not
conducive to settlement".
What settlement exactly is what I'd like to know.....
I'd suggest very strongly that the way they are treating their customers is far less conducive to
settlement than me documenting it.
At the same time, Expandify's solicitor has issued another breach notice threatening to terminate
Mum's contract if the next 30% isn't paid by 12 October.
Again, we are not refusing to pay. We offered to put the full amount into their solicitor's trust
account because they still have no nominee and because of the financial risk raised by their own
representative.
They still don't have a nominee. So where the hell is the QBCC?
Mum has already paid more than $130,000 for a home she still doesn't have. If they terminate
anyway, she then has to spend even more of her money on lawyers to fight it.
What is the point of having a building regulator, licensing requirements and consumer protections
if the customer still has to personally fund a legal fight just to make any of it mean something?
Since going public, I've spoken to many Expandify customers who are scared, angry, being ignored
and still waiting. So far, I'm yet to speak to anyone who has had meaningful installation work
progress in the past month.
I didn't build an entire website on a whim. Since April, I've spent what feels like a part-time job on
top of my actual full-time job trying to resolve this privately.
Imagine how far you have to push an ordinary customer before they decide the sensible next step
is to build and publish a website.
I've had enough of businesses getting away with treating people like this.
Everything I've published has been meticulously documented, and l'il continue using my voice,
loudly and publicly, until we get somewhere.
We are scared. This is my mum's life savings. Everything she had. But being scared doesn't mean
being silent.

Weaponising the fear of losing a home and life savings. Tying project
completion to us backing away from our solicitor and QBCC involvement.
And now, defensive public claims that don't match the record instead of any
accountability.
I'm not interested in letting that be swept under the rug. Ethical conduct
matters.

I had a builder go bankrupt that did modular buildings in china and I got my full
qbcc deposit back so yes it is absolutely possible.
And okay well that's fair enough but isn't this all just allegations. Haven't seen a
shred of evidence in literally any of your posts.

Are you paying $200k for a expandable out of China? Seems very overpriced for a
container home

Lucas Barry Baker yes, though to be fair it's quite large and has a lot of custom
add ons. We wouldn't feel ripped off if it'd been installed by now

Why don't you contact the QBCC
If the issue is you've paid money and you've gotten nothing then do a Deemed policy
through QBCC and be done with it
Your money issue seems to be with expandify not affordable modular so why the mud
dragging

We have contacted the QBCC. Mum's house was manufactured in China, so
QBCC cover doesn't simply cover the structure itself or refund everything she's
paid
So unfortunately it's not as simple as do a deemed policy and be done with it.

But what exactly do you consider mud dragging here?
If you think anything I've published is inaccurate, please tell me specifically
what.
I consider this documented consumer awareness.
We're talking about payment coercion. Ignoring a health-related instruction.
