Expandify’s solicitor said the dwelling had arrived at the Australian port on 30 August and that Expandify was ready to arrange release, delivery and placement after receiving the $67,200.91 instalment. The email said foundation preparation was underway. It acknowledged that Expandify was securing a new nominee but maintained that the company could lawfully carry out the preparatory work in the meantime.
It offered to amend the agreement so ownership would transfer on payment of this instalment, rather than after full payment, and warned that storage costs could accrue if payment was delayed.
